Municipal Powers and Functions

UPSC Civil Services• POLITY• Local Government• Municipal Powers and Functions
Municipal powers and functions constitute the functional foundation of urban local self-government in India. Article 243W, introduced through the 74th Constitutional Amendment Act, 1992, enables State Legislatures to endow Municipalities with powers and responsibilities necessary to function as institutions of self-government. These may include preparation of plans for economic development and social justice and performance of functions relating to the 18 matters listed in the Twelfth Schedule. Key areas include urban planning, land-use regulation, roads, water supply, sanitation, public health, fire services, urban forestry, slum improvement, urban poverty alleviation and public amenities. However, the Twelfth Schedule does not automatically devolve all 18 subjects to Municipalities; actual devolution depends substantially on State legislation. Effective municipal governance therefore requires genuine devolution of functions along with adequate funds and functionaries.

29. State Legislature and Municipal Functions

State Legislatures have a decisive role in:

  • Devolving functions
  • Defining powers
  • Assigning responsibilities
  • Providing financial authority
  • Establishing administrative arrangements

Golden Principle

Municipal Self-Government is constitutionally recognised but operationally dependent on State legislation.

30. Functions, Funds and Functionaries

Effective municipal functions require:

Functions

Clear responsibilities.

Funds

Adequate resources.

Functionaries

Adequate personnel.

Formula

Functions + Funds + Functionaries = Effective Municipal Governance

31. Functions Without Funds

If Municipalities receive responsibilities without adequate resources:

Function Devolution → Weak Implementation

Examples:

  • Water responsibility without adequate infrastructure funding
  • Waste management without sufficient revenue
  • Road maintenance without adequate budgets

Principle

Money Must Follow Functions

32. Functions Without Functionaries

Even when powers and funds exist, insufficient personnel can reduce effectiveness.

Needed expertise may include:

  • Engineers
  • Urban planners
  • Public health officials
  • Finance professionals
  • Environmental specialists
  • Data professionals

Principle

Authority + Money + Capacity

33. Municipal Powers and Democratic Decentralisation

It seeks to make Municipalities:

Institutions of Self-Government

Three Dimensions

Political

→ Elected representatives

Functional

→ Devolved responsibilities

Fiscal

→ Financial resources

34. Municipal Powers and Service Delivery

Municipal functions also have a social dimension.

Relevant Twelfth Schedule subjects include:

  • Weaker sections
  • Slum improvement
  • Urban poverty alleviation

Objective

Inclusive Urban Development

39. Municipal Powers and Citizen Participation

Local functions are most effective when citizens participate through:

  • Ward Committees
  • Public consultations
  • Local grievance systems
  • Community monitoring
  • Participatory planning

Constitutional Link

Article 243S → Ward Committees

for Municipalities meeting the constitutional population threshold.

40. District Planning Committee

Municipal planning operates at multiple levels:

MUNICIPALITY
      ↓
LOCAL URBAN PLANNING
      ↓
DPC / MPC
      ↓
INTEGRATED AREA DEVELOPMENT

Principle

Local Planning + Regional Coordination

43. Major Challenges

1. Incomplete Devolution

Not all Twelfth Schedule functions are meaningfully devolved.

Multiple agencies may perform urban functions.

Result

Fragmentation

3. Weak Financial Capacity

Municipalities may lack adequate resources.

4. Administrative Capacity Constraints

Shortages of:

  • Technical staff
  • Urban planners
  • Financial experts

5. Rapid Urbanisation

Demand for services may grow faster than municipal capacity.

44. Functional Devolution

Functional devolution means transferring:

Authority + Responsibility

to Municipalities.

Effective Devolution Requires

  • Legal authority
  • Financial resources
  • Personnel
  • Decision-making autonomy
  • Accountability

Formula

Legal Devolution + Fiscal Devolution + Administrative Devolution

45. Formal vs Effective Devolution

Formal Devolution

A function is assigned to the Municipality in law.

Effective Devolution

Municipality actually has:

  • Authority
  • Funds
  • Functionaries
  • Decision-making capacity

Golden Principle

Formal Devolution ≠ Effective Self-Government

46. Strengthening Municipal Powers

1. Genuine 3F Devolution

Transfer:

Functions + Funds + Functionaries

Clearly define responsibilities between:

  • Municipalities
  • Development authorities
  • State agencies
  • Special-purpose agencies

3. Strengthen Municipal Finances

Improve:

  • Property tax
  • User charges
  • Grants
  • Municipal borrowing capacity

Golden UPSC Concept

Article 243W does not itself transfer all 18 Twelfth Schedule subjects to Municipalities. It enables State Legislatures to endow Municipalities with powers, authority and responsibilities necessary to function as institutions of self-government. Thus, the real extent of municipal functional autonomy depends substantially on State legislation and the actual devolution of the 3Fs.
