UPSC Civil Services• POLITY• Making of the Constitution• Enactment and Commencement of the Constitution
Explains the final stages of constitution-making, including adoption on 26 November 1949, signing on 24 January 1950, commencement on 26 January 1950, the significance of Purna Swaraj Day, Article 394, the transition from Governor-General to President and the distinction between independence and becoming a republic.

Enactment and Commencement of the Constitution

1. Introduction

The making of the Indian Constitution was a gradual process that culminated in its adoption on 26 November 1949 and its commencement on 26 January 1950.

These two dates are important because:

26 November 1949 → Constitution adopted

26 January 1950 → Constitution came into force

The Constitution was therefore adopted before it became fully operational.

2. Draft Constitution

The Constituent Assembly worked on the Constitution through committees, debates and amendments.

The Draft Constitution was prepared under the leadership of the:

Drafting Committee

whose Chairman was:

Dr. B.R. Ambedkar

The draft was subjected to extensive discussion and amendment in the Constituent Assembly.

3. Constitution Adopted on 26 November 1949

The Constituent Assembly formally adopted the Constitution on:

26 November 1949

This date is now observed as:

Constitution Day

The Constitution originally contained:

  • 395 Articles
  • 22 Parts
  • 8 Schedules

4. Why Constitution Day Is Celebrated

The Government of India declared:

26 November

as:

Constitution Day

The day commemorates the adoption of the Constitution by the Constituent Assembly.

It highlights the constitutional values of:

  • Democracy
  • Justice
  • Liberty
  • Equality
  • Fraternity

5. Signing of the Constitution

The Constitution was signed by members of the Constituent Assembly on:

24 January 1950

This occurred two days before the Constitution came into force.

The signing marked the final formal stage before the establishment of the Republic.

6. Constitution Came into Force

The Constitution came into force on:

26 January 1950

India then became:

Republic of India

The date was deliberately chosen because of its connection with the national movement.

7. Significance of 26 January

On:

26 January 1930

the Indian National Congress observed:

Purna Swaraj Day

This date symbolised the demand for complete independence.

When choosing the date for commencement of the Constitution, the Constituent Assembly selected:

26 January

to honour this historical commitment of the freedom movement.

8. Why Not 15 August?

India became independent on:

15 August 1947

However, the Constitution did not come into force on that date.

The Constitution came into force on:

26 January 1950

Thus:

15 August → Independence

26 January → Republic + Constitution in force

9. Partial Commencement on 26 November 1949

An important constitutional detail is that not every provision waited until 26 January 1950.

Certain provisions came into force immediately on:

26 November 1949

These included provisions relating to:

  • Citizenship
  • Elections
  • Provisional Parliament
  • Transitional provisions
  • Definitions
  • Short title
  • Commencement

The remaining provisions came into force on:

26 January 1950

This is an important UPSC Prelims point.

10. Article 394

Article 394 deals with the commencement of the Constitution.

It provided that certain provisions would come into force immediately upon the Constitution's adoption.

The remaining provisions came into force on the date specified:

26 January 1950

Therefore:

Article 394 → Commencement of Constitution

11. Republic of India

With the Constitution coming into force on 26 January 1950:

  • The office of the Governor-General ceased
  • The constitutional system of independent India came into full operation
  • India became a republic
  • The President became the constitutional head of the Union

12. First President of India

Dr. Rajendra Prasad

became the:

First President of India

He was elected President of India on:

24 January 1950

He assumed office when the Constitution came into force on:

26 January 1950

13. End of Governor-General's Office

Before the Constitution came into force, India was an independent Dominion with the:

Governor-General

as its constitutional head.

After 26 January 1950, the office of Governor-General was replaced by the:

President of India

Thus:

Governor-General → President

14. Constitution and Independence

The Indian Independence Act, 1947 and the Constitution represent two different stages.

Indian Independence Act, 1947

Ended British rule and established India as an independent Dominion.

Constitution, 1950

Established the constitutional framework of the Republic.

Therefore:

1947 → Political independence

1950 → Constitutional Republic

15. Constitution as Supreme Law

After commencement, the Constitution became the supreme law governing:

  • Legislature
  • Executive
  • Judiciary
  • Union-State relations
  • Citizens' rights
  • Constitutional institutions

All governmental authority operates within the constitutional framework.

16. Transitional Arrangements

The Constitution contained transitional provisions to ensure continuity during the change from colonial administration to constitutional government.

These provisions addressed matters such as:

  • Existing laws
  • Existing institutions
  • Public services
  • Legislative arrangements
  • Administrative continuity

This helped prevent a sudden institutional vacuum.

17. Continuity of Existing Laws

The Constitution did not automatically abolish every law that existed before 26 January 1950.

Existing laws continued to operate to the extent that they were not inconsistent with the Constitution and subject to constitutional provisions.

This principle provided legal and administrative continuity.

18. Constitution and Constituent Assembly

The Constituent Assembly had a dual role during the transition.

It functioned as:

Constituent body

Framing the Constitution.

Legislative body

Making laws for independent India.

After the Constitution came into force, the new constitutional Parliament replaced the transitional legislative arrangement.
