The Constitution-makers did not adopt foreign provisions mechanically.

  • Political diversity
  • Colonial administrative experience
  • Freedom movement
  • National unity
  • Economic conditions
  • Democratic requirements

Foreign constitutional principles were therefore:

Selected → Modified → Adapted → Integrated

17. Why Borrow Foreign Features?

17.1 Existing Experience

Foreign constitutional systems provided tested institutional models.

17.2 Avoiding Unnecessary Experimentation

The framers could learn from the successes and failures of other constitutional systems.

17.3 Indian Requirements

Some foreign principles were considered suitable for India's circumstances.

17.4 Administrative Continuity

The Government of India Act, 1935 provided an existing administrative framework that could be adapted.

17.5 Constitutional Innovation

The framers combined ideas from different systems rather than adopting a single foreign model.

18. Indian Constitutional Synthesis

The Constitution combines:

British parliamentary government

American rights and judicial review

Irish DPSP

Canadian federalism

Australian concurrent powers

French ideals

Soviet-inspired duties

Indian administrative experience

This produced a distinctive constitutional system.

UPSC Mains Perspective

The borrowed features demonstrate that constitution-making involved comparative constitutional learning.

However, the Indian Constitution should not be described simply as a collection of foreign provisions.

The framers:

  • Selected suitable institutions
  • Modified them
  • Combined different traditions
  • Added provisions based on Indian experience
  • Created new constitutional arrangements

Mains-ready conclusion

The Indian Constitution represents constitutional synthesis rather than constitutional imitation. Its borrowed features were adapted to India's democratic, federal, plural and socially transformative requirements, producing a constitutional framework that is distinctly Indian in its overall design.
